Hey Folk's, there is a whole lot of information about what is happening in this biz and although it's good to keep on top of it, we are not lawyers and should not be making opinions on this.


If we are serious about really knowing what is going on, I am all for contacting an attorney andgetting a legal opinion.


We need to take a proactive position here and get the FACTS and not our owninterpretation of what we are reading and hearing.


Ifor one do not want to pack it in and call it fun while it lasted. Having said that, I do want to follow the law and we need to KNOW what that is.


If some ofthe OP's we deal with will not make their own attorneys opinions known to us, then we will have to do it on our own.


We need specific guidelines about what is and what is not acceptable in the eyes of the DEA.


MedsDirect, you seem to have contact with a good attorney in this matter. Can we form a group and pay them to give us an opinion??


Those of us who want to keep going with this greatBiz can't give up so easy!!!

I am just amazed at how some of these coward companies aren't stepping to the plate and informing affils about the condition of the industry, or the game plan, or just say they are working on it. Take into consideration that we have made them millions. The only one I have seen that have said anything pro-active is USAPrescription to let us know they are not taking this lying down. Some type of response would we great instead of leaving it to affils to sit and try and decide what the future is or try and get attorneys.


If you ask me, this is rediculous.


This is just my opinion. I am a newbie in the forum, but have been following the activities for a while.

On a per sale basis, the affiliate makes the most money. I think the affiliate can afford legal counsel if there is a need. Or a cooperative effort from those that chip in $1-2K each for the absolute answers. The best internet OP attorneys are not cheap. trust me.

You could always give them a call and ask. I'm sure their lawyers don't want them to say anything on a public forum. IMO the reason USAPrescriptions is proactive is becuase they got raided. They had to respond to that.

Good Points.


I would like to see the Op's make this top priority for there affiliate partners. We all have so much at stake here and working together is the best possible scenario...


BTW, affiliate applications have declined in a big way this week. The faster we can get clarity on these issues the faster we can get back to business...

Affil: if you process thru EVA, you used to see that Lifeline was one of the pharmacies


If you process thru USAPrescription, I am assuming you used to see that RxNetwork was one of their pharmacies.


Both EVA and USAPrescription are still processing orders.


Only USAPrescription made a statement.


This is not a guessing game.

Do you live in a 5.5 mil house? Own a house ontheBeach?owns however amount of Mercedes, etc, etc.????


Can you open a 1 mil call center? We make good money but don't fool yourself.


All I was saying is, these companies already have high powered attorneys in place and they OWE it to affiliateswho line their pockets to make a statement/advise what the next round is. They do not have to tell us their legal strategies. They can even have their attorneys draft a damn B.S. letter and post or e-mail to all their affils.

The OP's don't care about affiliates. Have you guys heard from tubbs in the last month or two? And he is not even an OP. He made aabout 1-2mill off all you guys for doing absolutely nothing and could care less about replying to anyone now. HOw much you think the OP's make then? You all here don't make in a year what they do in a day (me included)

I heard the DEA busted Doug. He is now working with them to prosecute all his affiliates and this is why you have not heard from him in over a month. And you all thought he was such a "great guy"

Doug made all this money from you guys and now he might get you 20yrs. From what I understand, he is fully cooperating; providing names, addresses, bank accounts, phone numbers, SS#, etc. That is probably why onlinerx got busted by DOJ.

As far as the OP's stepping up and making statements, we try, but if it looks at all self promotional, the posts get instantly deleted. I've lost a few related to this.


We have a very, very difficult time communicating here if we dont have our own forum, and for those that do have their own forum here, I'm not sure if they can post this type of stuff either without being deleted.

I see Pharmboy of rxmedical and that guy that post in everbody's forum but his; Brian of MWS. I don't see them getting banned because they discuss the issues brought forward most of the time. On Brians part, I can see some of it being self-promoting.

I'm talking about details specific to the OP in question.


If I post in length about what we are doing, the legal implications, additional product offerings (to replace controlled substances) etc. it gets deleted.


If I post general legal information it gets to stay.

Sure, I'll get in touch with our attorney and see if he can be an assett for everyone. His firm represents many of the main OPs, and is a specialist in the industry.


His contracted fees are over $300.00 an hour, I'm not sure if that varies for non clients without a retainer ( we pay a pretty heavy retainer that gets renewed on a regular basis.)


I'll see what we can set up.

Guys, you keep saying the ops need to do this or that, but the truth is this business can be anything you want it to be. We control traffic, huge amounts of it. Big Buisness has seen that this is a market that's ready for the picken. You think the DEA just figured out that you guys are out here. The document that just keeps getting posted is 2 years old. What just got figured out is just how much money is involved. Brick and mortar pharmicies (including Wallmart) want you out of buisness, butdo you really believe that once your gone they won't fill the void.


The real discussion here should not what we sell, but how we expand this buisness intoit's potiental. Do you really want to just want to bend over and let wallmart take everything you've worked for. I'm a big picture kind of person, things don't happen for no reason. This is a corporatetake over, not an exercisein justice.


The supreme court has been very clear in all of it's ruling, the federal government has no place in doctor patient relationships. I belive if the DEA is involved in another raid aganist an online OP not breaking the law, they themselves will be violating a ruling of the supreme court.The specifics of the recent ruling forbade the federal government from participating in any endevour that would interfere in the doctor patient relationship including arrest, revocation of DEA license or intimidation. The case involved an illegal drug,mary jane, and the right of a doctor to advise or to prescribe the medicine. There have been numerous cases brought before the courts, and I don't know of one that the feds have prevailed, when doctor patient relationships were involved.


We need to clean up the image of our industry. We don't need to wait on the feds or the states to regulate us. If you haven't noticed lately the stock markets way up and jobs are way down. It seems to me one of the boys have taken a liken to our business and are just using some free muscle to take it over. They want you out, so they can come in. They don't like to compete, they like to be the only show in town.

The OP's are providing meds people wouldn't otherwise get, in my opinion. If it wasn't for the OP many people ordering viagra, weight loss pills, etc. would not otherwise make a doctor appointment to get the meds. So everyone will lose out including the drug manufacturers. I don't see brick and mortar picking it up, and they are already online.

A big first step would be for OP to stop affiliates spamming for meds. I was at a dinner the other night with people who did not know I have OP affiliate sites all complaining about the spam pushing meds. The DEA also have make a comment about the amount of spam pushing drugs online. A good clean industry does not allow spam in my opinion.

Ops are businesses that have made an agreement with pharmacies, doctors amd information processors to handle prescriptions. As friggin fried as I am, if I propose to make someone 100 to 200 million a year I believe they'll go for it. On the other hand if I'm an op and have no traffic I'm screwed. That's my point.


CVS and wallmart do not provide consultations, they're pi--ing in the wind. But if our industry disappears they're prospects brighten immediately. Let's say thet just pick up 30% to 40% of our volume at no cost because we're no longer in buisness, I'd say that's pretty good. You can bet your sweet ass drugstore.com is one of the biggesttrouble makers, this is because their facial cream and beauty aid site has been blown from page 1 to page 10. They offer a totally useless service because they do not have brick and mortar establishments.


Wallmart on the other hand does, so I could drop my script off and anytime I needed a refill go online and reorder. My guess after we depart, if we do there will be an association of doctors that work for one of the bigboys that are real understanding.


Right now we have all the marbles, traffic, order processing, medical consultation, the entire infrastructure of a sucessfull 21th century medical delivery service. We have got to get that out to the public, because right now what the public is hearing is that we're low life scum bag selling drugs on the shady side of the internet. That's my point, this is not an exercise in law enforcement, do you really think they give a damn, this is big business politics.
