View Full Version : DOJ visits affiliate

I just wanted to warn everyone that Friday morning my house was
visited by the DOJ. I have14 websites that sell products through
many OP's. (I rather not mention which sites I run.)

They had a search warrant and we were not allowed to leave until
we were each questioned one by one. We were asked questions
about which sites we own, how long we have been advertising sites
and how often we get paid, and by who.

They took all my cmputer equipment and some paperwork that
I had out on my desk. I had to go buy another computer just to
get back online. They took my monitors also. I lost all my notes, emails and phone list that were only on my computer. I don't know why they picked me for this or if anyone else is on their list. They were very intimidating.

This was very embarrassing to me since I always tell my
wife that I do not do anything illegal on the web. I can't wait to
hear what my gossiping neighbours are saying. Luckly my children
were at school so they didn't get to see any of it.

That's pretty much the end of it for me. I am not going to wait
to see what their next move is and I am going to definitely plea
my way out of anything I can. I also now think that everything
in rxaffiliateforum.com is evidence since their people read this
site. Best of luck and thanks for this forum and the information.

I don't believe it. Why would they come after you, and not go to EVA, IHC, MWS or whoever?! You didn't write any prescriptions! You didn't fedex any drugs! You didn't do anything illegal! What kind of judgewould sign a warrant like that?

I agree with Rob, this doesn't make sense.

This dude is a retard. They wouldn't just take the papers on his desk, they would take everything listed on his warrant. And they wouldn't waste time on some small fry- we already know that by lifeline and rxnetwork getting hit and not eva and usa. I challenge him to post the warrant by midnight tonight. PLus it would be the dea and they already know all those answers. Any one could find those kiddy porn answers in a few minutes on their own!

Why didn't they take him away and his web server?

And all this before they have even reprimanded the first physician? He must have been selling offshore stuff. A LOT of offshore stuff.

Sick joke...really sick, considering that some people really are nervous about all this, and the question on everyone's mind is regarding the affiliates...shame on you. smileys/smiley7.gif

I've got to say, that really burns me up, as hard as I have worked (and still work) to make this go!!!!!

BRING IT ON!!!! I wouldn't be scared of the DEA anyway. It is CONCEIVABLE (but not likely) that they could try to gather evidence against the big boys. Even if there were a raid (ha, ha, right), that doesn't mean that the DEA has any plans to bring charges against the affiliate!!!

Give me a break!!

Hey, yeah, give me just one of your sites if you were such a heavy hitter.

Right Kay :)

It was a trick question, the correct answer would be "underwear", due to dress down Fridays.

This is just my spin on things regarding to myself....and perhaps many, many of us Affiliates here at the Board, alot of us are very new at the OP Affiliate Marketing business and alot of us have been at this for many yrs., I read this board many times a day,I am beyond grateful that it was put up,because I have always just gone along and put up sites and tweaked them, not paying attention to the newscasts, etc.

Were it not for this Forum,Affiliates would not know of all these newspaper articles and the behind the doors if you will going ons...I work very, very hard with my sites as do most of us here, its getting very hard to keep up with what meds. to be pulling or keeping on your sites, but I know for sure that the majority of all of us are HONEST and trying to adhere to all the changes. To come and raid one of our homes or to have us all in High Anxiety State...really sucks, but we are not and were not at the onset of this OP Biz stepping up to the plate thinking we could be arrested or thinking the DOJ or DEA would be knocking on our doors,I keep all my records and files etc. I pay my taxes and am truly trying to keep up with all of this and adhere to each OP's statements, sure its overwhelming but ,its got to be done...I dont truly know if the poster is telling the truth or not...but I for one would not be online and back at a Forum he/she says(is being watched)or maybe at this point he/she could care less and thinks this is a wonderful heads up.....NOT..if this poster were a regular and simply came in and said ...to all of us Its TIME TO STOP.....so to believe or not to believe this posting is the question...I do know from the newspaper biz that when law enforcement comes to confiscate your computer and all your files etc.....YOU TAKE THE TRIP WITH THEM!! this is not mentioned at all, this person doesnt seem all that scared, and claims to have gone out and bought a new computer to get online...(by the way that is what you need to go online a computer and an ISP lol)IF THAT WAS ME....and that post was the truth....I WOULD NOT BE ON MY COMPUTER....prolly in jail and or out on bail , scared shi--less, and not at the store buying a new computer, I would be pondering what is going to happen , what about my wife and children.....oh there we go it is a he...has a wife lol...he mentions we alot, and computer in the plural....maybe IF this is true there were many people in the home and invloved ....just something not right here ...sorry for the long post.....smileys/smiley1.gif

This thread is just getting ridiculous....if you are abiding by the law and following each OP/DEA and their instructions on what Meds you can or cannot put up on your sites...why is everyone getting paranoid...?? IF YOU ARE AN AFFILIATE THAT IS DEALING WITH OVERSEAS OP'S and selling the meds out of your house ie:your own little shop of horrors ...then YOU SHOULD BE SCARED sh*tLESS(and you deserve to get busted)...otherwise this is plain stupid IMHOsmileys/smiley2.gif

I agree dewie. I've never put Vicodin or other similar drugs on my sites. Since all this started I haven't changed one med that I have on any site, and I won't until the pharmacies drop the meds.

I don't anticipate the DEA dropping in, but if they did I'd give 'em a cup of coffee and let them take whatever was on the warrant. but first,I'd call my attorney, of course.

The interview I read and listened to was clear, if you don't have physical custody of the drug, or don't write the script, you aren't trafficking in narcotics.

Frankly, the civil suits worry me more than the criminal

kaylowe
October 25th, 2003, 06:25 PM
Well said, Mary. Very well said. We have NO criminal liablility here at all, and, truly, I believe that our civil liability is limited, too. Basically, all we do is advertise for OP. And, unless we were targeting our advertising to minors, or to obtaining drugs ILLEGALLY, I don't see where we have any liability.

I do wish that our base OPs would help us by tweaking the software to screen for minors, BMI, etc. If the person ordering enters a date that indicates that he/she is not 18, the order stops. "Sorry, we are prohibited from prescribing to anyone under age 18". "Sorry but you do not meet the criteria/standards for prescribing phentermine". Would be a help, I think.

Admin, what about this "Al-Queda" joker?

Kay

We are and could be criminally and civily liable for sure. But the chances of someone coming after chump affiliates like us in slim to none

Star
October 25th, 2003, 07:06 PM
just you personally, but your company can still be sued, and if you don't follow all the rules the corporation is useless and you will be personally liable. You should have set up an llc for your ventures when you started

kaylowe
October 25th, 2003, 07:24 PM
Star. how do you figure that we are criminally liable? We have done nothing criminial. At all. IF anything criminal HAS been done, it is the pharmacy and/or MD. Civil liablilityis questionable.

"al-queda", I apologize if you think I was harsh. I only saw someone trying to keep this paranoia going. Sorry if I was wrong.

I am not an attorney, of course. But I see no criminal liability here. In civil suits, however, anything goes these days.

Bu-- sh--

The department of Justice does not serve warrants, that's why we have the friggin FBI. Attorneys don't carry guns. Hell I've got PTSD, and this kind of crap doesn't even screw with me. Settle down guys. I've read the DEA brief, and you've only got to worry if you conspire to break the law.

Our friend who was raided(BS) claims they took everything and questioned him. Whar the hell would he know that could help them. He's like the rest of us, we're out of the primary loop of who, where, and how.

Do you really believe it would help them to know that k.s. of little rock bought some adipex. They have to go to the op, doctor or pharmacy to get any meaniful info.

If you like what you do( I believe I'm helping people who are suffering ), It's besides the point that I get paid. Start entering into meaniful discussions on self regulation, or some very mean people who could give a damn about you or your family, or people that are in agony, will regulate it for you. Don't wait for the other shoe to drop.

In addition court rulings are going in our favor. Changes, regaurdless of intent, are always met with resistance. If you fear reprecussions, then you are not a coward, but aware of the political climate. I'm an ex-marine and I can tell you from experience everybody is a hero until the firstround is fired, but I can tell you that our cause is a just cause.

This is the future of medicine, next year our seniors medical benefits will be greatly reduced. It was done under the guise of a newsenior drug benefit. What it really is, is a death sentence for the poorest of our seniors.Theyhave been sentanced to VA type medical care. From personalexperience, only doctors that have no other choice will participate in the new program and a full court press will be on to limit expenditures, probally using the VA method of bonuses paid for those that get put in the grave.

The politicians are in our court, all we have to do is regulate ourselves, if we save them money, andconduct our business in a legal and safe manner, the bad sh_t will go away. We operate the most efficent mode of home health care to be ever conceived of, it's a damn shame we're allowing them to paint us in such a damn negative fashion, when they're the ones killing people so a few people can get a tax cut.

I went out for 2-3 hours and return to findthat a sh*t stirrer has started a new post which left me breathless for a minute or two. BTW DOJ took his computer and some papers but they left his money and credit cards etc. alone so he can buy a new computer and get online ASAP or run away. What a moron. Can't even tell a credible lie.

Well saidicollect. It seems to me we have to look at who benefits the most if the OP's go out of business.

And this "face to face" between the doctor and the patient is a bunch of bull sh*t. Last year my wife went to the doctor, but her regular doctor was not there. She was examined by another doctor and prescribed a medicine. Luckily the local pharmacy did not fill it becauseit hadcodiene as part of the compound and she is highly alergic to it. If she had takenit, she would not be with me today!

To me, a big fuss in being made because of a few bad guys in the OP business, 99% of them overseas, and individuals who will not take responsibility for their own actions.

It seems funny to me that the Feds went after a guy who put illegal material on an airplane to call attention to lack security, but nary a word is said to Bo Dietz (whatever his name is)and his underage daugther when she orders drugs over the internet illegally.

Hell, I'm going back to work to put more sites up.

If all OP has to offer is ordering online - they can go to "drugstore.com". "walgreens.com", etc, etc. Any of these will fill a legit rx. Why bother? Stop at CVS on the way home.

Just my $.02.
