Are the problems aligned with US residents being affiliates of US companies trying to sell into the US or are they US citizens being affiliated with overseas companies selling into the US or is it foreign residence affiliated with US companies selling into the US or outside of the US, etc., etc.?
As far as I can tell there are no problems if you live inside or outside the US, selling non-US sourced medicines to US citizens.
If you're having a problem and your income is large enough to warrant it - move to the Bahamas.
There may be a few issues with the importation of certain medicines though. I'm talking about REAL medicines (prescription stuff). The FDA allows importation for PERSONAL use of any drug, especially ones that are not available in the US. However, the DEA has proscribed a number of medicines and labelled them 'steroids' or 'narcotics' and have made importation illegal.
This really needs to be sorted out by the FDA and DEA. How can the govt say that drug A is a medicine on the one hand and an illegal drug on the other? Sounds weird to me. I guess they just aren't talking to each other.
If you're selling herbals then you may have a new issues and that is the govts move to have companies prove that their herbal preparations are effective in treating what they say they treat. That will see the 'herbal' market hit very hard with almost ALL the companies disappearing from the US market. The costs of proof are very high and many of these companies know that there is no proof to be had no matter how much they spend.
