RXRob,
It depends in which country you want to start manufacturing and selling that generic version of Pfizer's Viagra.
Patent laws that protect Viagra are different in each continent.
Pfizer has a patent on the shape and color of the pill as well as the active ingredient , Sildenafil Citrate... But they do not have a patent on ED medication in general...

On November 8 2000, the United Kingdom's High Court ruled that Pfizer's European patent designated in the UK and covering the method of use of sildenafil, the active ingredient in Viagra, was invalid.
However, this patent only covers the use of phosphodiesterase V (PDE V) inhibitors in the treatment of impotence i.e. the way in which sildenafil works, not the drug itself.

<DIV>A legal attempt by the makers of Viagra to prevent competitors copying a key element of the drug has been thrown out by the House of Lords. The House of Lords' judicial office confirmed yesterday that the law lords will not hear an appeal by Pfizer over the impotence drug. Pfizer could soon find itself facing opposition in the $1.5bn (œ1bn) global market that is dominated by its diamond shaped blue pill. The law lords' decision means that the US-based drug company is effectively at the end of the legal road over the patent in question. Other companies will now be able to sell drugs that treat impotence by blocking PDE-5, a chemical, although Pfizer retains a patent on the active ingredient in Viagra - meaning that direct copies of the drug itself will not be permitted. In January, the Court of Appeal had agreed with an earlier High Court ruling that knowledge covered by the Pfizer patent on the "PDE-5 inhibitor" was already in the public domain</DIV></DIV>
Basically each country has it's own laws...
I can pull out some more info , but we would need to aggree on which country we are talking about.
